These Terms of Service ("Terms") govern your access to and use of SmartSwap ("Service"), operated by SmartSwap ("we", "us"). By registering an account, accessing the website at smartswap.site, or using any part of the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time. We will notify you of material changes by email with at least 14 days' notice.
You must be at least 16 years old to use SmartSwap. By using the Service, you confirm that you meet this requirement. If you are between 16 and 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Choose a strong, unique password and do not share it with anyone.
You agree to provide accurate, current information when registering and to keep it up to date. You may update your details at any time in Settings.
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in abuse of the platform.
Free plan. You may use the Service under the free plan with access to the features described on our pricing page. No credit card is required.
Paid plans. Member (monthly at $19/mo) and Member Annual ($149/yr) plans unlock all premium features. Paid plans begin with a 7-day free trial. You will not be charged until day 8. After the trial, your chosen plan renews automatically.
Cancellation. You may cancel your subscription at any time from Settings → Subscription → Manage billing, or by contacting support@smartswap.site. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not offer partial-period refunds unless required by law.
Refunds. If you are charged in error, or if the Service is unavailable for an extended period due to our failure, contact us within 14 days and we will issue a refund. We do not refund charges for unused periods of a subscription.
Price changes. We will give you at least 30 days' notice before changing subscription prices. Annual members locked in at the time of their purchase retain their rate until renewal, at which point the new price applies.
Payment processing. Payments are handled by Stripe. By subscribing you also agree to Stripe's terms of service.
You agree to use SmartSwap only for lawful purposes and in accordance with these Terms. You must not:

Breathwork safety. Never practise breath holds or hyperventilation-style breathing while driving, in or near water, or in any situation where loss of consciousness would be dangerous. Always practise seated in a safe environment. Certain breathwork techniques can cause lightheadedness or temporary loss of consciousness. If you feel unwell, stop immediately.
SmartSwap is not liable for any injury, illness, or adverse outcome resulting from use of the Service. You use the breathing, meditation, and health tools entirely at your own risk.
All content on SmartSwap — including text, design, graphics, software, breathwork sequences, and educational content — is owned by SmartSwap or its licensors and is protected by copyright and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Service without our prior written consent.
Your content. You retain ownership of any notes, journal entries, or other content you create within the app. You grant us a limited licence to store and process this content solely to provide the Service to you.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.
We aim to provide the Service continuously but cannot guarantee uninterrupted availability. We may perform maintenance, updates, or experience outages. We will provide advance notice of planned maintenance where possible.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we discontinue the Service entirely, we will provide at least 30 days' notice and offer a pro-rated refund to active paid subscribers.
To the maximum extent permitted by applicable law, SmartSwap and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
You agree to indemnify and hold harmless SmartSwap, its operators, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer in another jurisdiction with mandatory local consumer protections, in which case those protections apply.
We encourage you to contact us at support@smartswap.site before pursuing any formal dispute — most issues can be resolved quickly this way.
You may stop using the Service and delete your account at any time. We may terminate or suspend your account immediately if you violate these Terms. On termination, your right to use the Service ends. Sections of these Terms that by their nature should survive termination (including sections 6, 7, 10, 11, and 12) will continue to apply.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and SmartSwap regarding the Service. They supersede any prior agreements or representations. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
